Welcome to fyyn. These Terms & Conditions ("Terms") govern your access to and use of the fyyn. platform at fyyn.io ("Platform"), including all related services, features, and content. By accessing or using our Platform, you agree to be bound by these Terms. If you do not agree, please do not use our services.

1. Agreement to Terms

By creating an account or using the Platform, you confirm that you have read, understood, and agree to these Terms. We reserve the right to modify these Terms at any time. Continued use of the Platform after changes are posted constitutes your acceptance of the revised Terms.

Our services are subject to ongoing development and improvement. We do not guarantee uninterrupted availability, specific uptime levels, or error-free operation. You acknowledge that service features may change over time.

2. Intellectual Property Rights

All content on the Platform, including but not limited to source code, databases, software, website designs, text, graphics, and trademarks, is the property of fyyn. and is protected by applicable intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to use the Platform for your personal or internal business purposes. This license does not include the right to reproduce, distribute, modify, or create derivative works of our Platform or its content, except as expressly permitted.

Your Content: You retain ownership of any real estate listings, images, descriptions, and other content you submit through the Platform ("User Content"). By submitting User Content, you grant us a license to use, process, and display it as necessary to provide our services, including the generation of AI-powered real estate videos.

3. User Representations

By using our Platform, you represent and warrant that:

  • All registration information you provide is accurate, current, and complete.
  • You have the legal capacity to agree to these Terms.
  • You are of legal age in your jurisdiction (at least 18 years old).
  • You will not access the Platform through automated or non-human means (bots, scripts, etc.) without our prior written consent.
  • You will not use the Platform for any unlawful or unauthorized purpose.
  • You have the right to submit any content (including property images and descriptions) that you upload to our Platform.

4. User Registration

Access to the Platform requires account registration. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

We reserve the right to suspend or terminate accounts at our discretion, including for violation of these Terms or inactive accounts.

5. Fees, Billing & Subscriptions

Access to the Platform requires a paid subscription. By selecting a subscription plan, you agree to the following:

  • Billing Cycle: Subscriptions are billed on a recurring basis (monthly or annually) depending on the plan you select. Your subscription automatically renews at the end of each billing cycle unless cancelled.
  • Payment: You authorize us to charge your chosen payment method for all applicable fees. All payments are processed securely through our third-party payment provider (Stripe). We do not store your credit card information.
  • First Month Pricing: Certain plans may offer a discounted introductory rate for the first billing cycle. After the introductory period, your subscription will renew at the standard rate for your selected plan.
  • Price Changes: We reserve the right to modify subscription pricing. Any price changes will take effect at the start of your next billing cycle. We will provide reasonable advance notice of any price increase.
  • Failed Payments: If a payment fails, we may retry the charge and/or suspend your access to the Platform until payment is successfully processed. Accounts with overdue payments may be suspended or terminated.
  • Taxes: All fees are exclusive of applicable taxes. You are responsible for any taxes, duties, or government levies associated with your subscription.
  • Cancellation: You may cancel your subscription at any time from your account dashboard. Upon cancellation, your access continues until the end of your current billing period. No partial refunds are issued for unused time within a billing cycle.
  • Refunds: Please refer to our Refund Policy for details on eligibility and the refund process.

6. Prohibited Activities

You agree not to:

  • Systematically retrieve data or content from the Platform to create a collection, compilation, or database without written permission.
  • Circumvent, disable, or otherwise interfere with security features of the Platform.
  • Use the Platform to engage in fraudulent activity or misrepresent your identity.
  • Interfere with or disrupt the Platform or the servers and networks connected to it.
  • Attempt to gain unauthorized access to any part of the Platform, other accounts, or related systems.
  • Use the Platform in a manner that could damage, disable, or impair the service.
  • Upload or transmit viruses, malware, or other harmful code.
  • Use the Platform to compete with us or to develop a competing product or service.
  • Submit false, misleading, or fraudulent property listing information.

7. AI-Generated Content

Our Platform uses artificial intelligence to generate video content, scripts, voiceovers, and other materials based on your property listings. You acknowledge that:

  • AI-generated content may require review and editing before use.
  • We do not guarantee the accuracy, completeness, or suitability of AI-generated content.
  • You are responsible for reviewing all generated content before publishing or sharing it.
  • AI-generated content should not be relied upon as a substitute for professional real estate advice or factual property descriptions.
  • You are solely responsible for ensuring that any content you publish complies with all applicable advertising laws and regulations, including but not limited to FTC guidelines, state real estate advertising rules, and fair housing laws.

8. Social Media & Third-Party Platforms

The Platform generates content intended for use on third-party social media platforms (including but not limited to Instagram, TikTok, YouTube, and Facebook). You acknowledge that:

  • You are solely responsible for complying with the terms of service of any third-party platform on which you publish content generated by our Platform.
  • We are not liable for any consequences arising from your use of generated content on third-party platforms, including account suspensions, content removals, or policy violations.
  • We do not guarantee that generated content will meet the specific requirements or guidelines of any third-party platform.

9. Advertising Compliance

If you are a licensed real estate professional, you acknowledge that you are subject to advertising regulations in your jurisdiction. You are solely responsible for ensuring that all content generated through our Platform — including scripts, captions, and video overlays — complies with applicable advertising laws and regulations, including:

  • Federal Trade Commission (FTC) guidelines on advertising and endorsements.
  • State real estate commission advertising rules and disclosure requirements.
  • Fair housing laws prohibiting discriminatory advertising.
  • Any brokerage-specific compliance requirements.

fyyn. does not provide legal advice. We recommend consulting with a compliance professional or your brokerage's legal team regarding your advertising obligations.

10. Platform Management

We reserve the right to:

  • Monitor the Platform for violations of these Terms.
  • Remove or disable access to any content that violates these Terms or is otherwise objectionable.
  • Suspend or terminate user accounts at our discretion.
  • Modify or discontinue any aspect of the Platform at any time without prior notice.

11. Data Security

We implement reasonable technical and organizational measures to protect your data. However, you acknowledge that no method of electronic transmission or storage is 100% secure. We cannot guarantee absolute security of your data transmitted to or stored on our Platform. You use the Platform at your own risk and are responsible for maintaining the security of your account credentials.

12. Confidential Information

During your use of the Platform, you may receive or have access to confidential information belonging to fyyn, including but not limited to business processes, technical information, and proprietary features. You agree to keep such information confidential and not disclose it to any third party without our prior written consent, except as required by law.

13. Termination

You may terminate your account at any time by cancelling your subscription and contacting us. We may suspend or terminate your access to the Platform at any time, with or without cause, and with or without notice, including for violation of these Terms, non-payment, or at the request of law enforcement.

Upon termination, your right to use the Platform ceases immediately. We may delete your account data after a reasonable retention period. Provisions that by their nature should survive termination shall remain in effect, including Sections 2 (Intellectual Property), 5 (Fees), 7 (AI-Generated Content), 12 (Confidentiality), 15 (Disclaimer), 16 (Limitation of Liability), and 17 (Indemnification).

14. Service Availability

We strive to maintain high availability of the Platform but do not guarantee uninterrupted access. The Platform may be temporarily unavailable due to scheduled maintenance, updates, or circumstances beyond our reasonable control (including but not limited to server failures, internet outages, or force majeure events). We will make reasonable efforts to provide advance notice of planned maintenance.

15. Disclaimer of Warranties

THE PLATFORM AND ALL SERVICES ARE PROVIDED ON AN "AS-IS" AND "AS-AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Platform will be uninterrupted, error-free, secure, or free of viruses or other harmful components.

16. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FYYN. AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE PLATFORM, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES.

Our total liability for any claims arising under these Terms shall not exceed the amount you have paid to us in the twelve (12) months preceding the claim.

17. Indemnification

You agree to indemnify, defend, and hold harmless fyyn. and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to your use of the Platform, your violation of these Terms, your violation of any third-party rights, or your failure to comply with applicable advertising laws and regulations.

18. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Federal Republic of Germany, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Germany.

19. General Provisions

  • Entire Agreement: These Terms, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and fyyn. regarding the use of the Platform.
  • Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
  • No Assignment: You may not assign or transfer your rights under these Terms without our prior written consent. We may assign our rights and obligations without restriction.
  • No Waiver: Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
